APEXS is an authorized distributor of Davis Instruments weather monitoring hardware in the Philippines, providing station sales, installation, calibration, and support.
2. Acceptance of Terms
By visiting apexsinc.com, requesting a price quote, or ordering equipment/services, you agree to these Terms, our Privacy Policy, and Refund Policy.
3. Price Quotes Are 100% Free & Non-Binding
Submitting a "Get a Quote" or contact request is an inquiry, not a binding contract. An official order only exists when APEXS issues a formal invoice or written purchase order acceptance signed by both parties.
4. Ordering, Payment & Delivery
- Payment Methods: We accept bank transfers, official checks, and authorized LGU/corporate purchase orders. Online checkout transactions remain subject to these Terms.
- Title & Risk: Risk of loss passes upon delivery to your site or carrier. Equipment title passes upon full payment.
- Lead Times & Imports: Because Davis Instruments equipment is imported to order from the manufacturer, delivery lead times depend on factory production and customs clearance. APEXS will promptly notify you of any material updates.

All website design, content, and APEXS logos belong to APEXS, Inc. Davis Instruments product names, logos, and trademarks belong to Davis Instruments Corp. Nothing here grants a license to use these trademarks outside genuine equipment identification.

8. Limitation of Liability
To the extent permitted by law, APEXS is not liable for indirect, incidental, or consequential damages (such as lost business data or interruption). APEXS's total aggregate liability for any order is limited to the actual fees paid for that specific order (or PHP 10,000 for site-only inquiries). Nothing limits rights guaranteed under Philippine consumer protection laws.
9. Business & Government Indemnity
Business and LGU clients agree to indemnify APEXS against third-party claims resulting from improper equipment misuse or unsuited site installation conditions not caused by APEXS's negligence.
10. Data Protection & Privacy
Personal information is processed in accordance with our Privacy Policy and, where applicable for enterprise/LGU projects, our Data Processing Agreement (DPA).
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of the Philippines. Any legal proceedings shall be conducted exclusively in the courts of Lapu-Lapu City, Cebu.
